TERMS OF SERVICE

OVERVIEW

This website and online store are operated by Empire Motorsports & LINE-X. Throughout these Terms of Service, “we,” “us” and “our” refer to Empire Motorsports & LINE-X.

These Terms of Service govern your use of our website and your purchase of products or services from us. By visiting our website, submitting information, requesting a quote or purchasing from us, you agree to these Terms of Service and our Privacy Policy, Shipping Policy, and Return and Refund Policy.

If you do not agree to these terms, please do not use the website or place an order.

  1. ONLINE STORE TERMS

You must be at least the age of majority in your state or jurisdiction to make a purchase from this website.

You may not use our products, services or website for an unlawful or unauthorized purpose. You may not transmit viruses, malicious code or other material intended to interfere with the operation or security of the website.

We reserve the right to refuse or cancel service or orders as permitted by applicable law.

  1. PRODUCT INFORMATION

We make reasonable efforts to display accurate product descriptions, photographs, specifications, prices and availability. However, information provided by manufacturers, distributors and other suppliers may change without notice.

Product photographs are for general reference. Colors, finishes, dimensions, packaging and minor design details may differ from what appears on a screen. Manufacturers may revise products or packaging while retaining the same part number.

We do not warrant that all website information is complete, current or error-free. We reserve the right to correct errors and update information as permitted by applicable law.

  1. VEHICLE COMPATIBILITY

Customers are responsible for confirming that a product is appropriate for their vehicle and intended use before purchasing.

Vehicle compatibility may depend on factors including:

  • Year, make and model

  • Trim level

  • Cab configuration

  • Bed length

  • Drivetrain

  • Engine or transmission

  • Factory-installed equipment

  • Existing modifications

  • Emissions classification

  • Intended on-road or off-road use

Fitment information and website filters are provided as general reference tools and do not replace verification using the manufacturer’s current specifications.

Please contact us before ordering if you are uncertain about compatibility. Information provided by our staff is based on the vehicle and product details supplied by the customer.

Products cannot be returned after opening or installation merely because the customer supplied incorrect vehicle information or did not confirm compatibility, except where required by law or where we supplied the incorrect product.

  1. ORDERS AND ACCEPTANCE

Submitting an order does not guarantee acceptance or availability. We may accept, decline, limit or cancel an order for reasons including:

  • Product unavailability

  • Supplier inventory errors

  • Incorrect pricing or product information

  • Suspected fraud or unauthorized payment

  • Shipping restrictions

  • Regulatory restrictions

  • An inability to verify customer or vehicle information

If we cancel a paid order before shipment, we will refund the amount paid for the canceled portion.

An automated order confirmation acknowledges that we received the order. It does not necessarily mean that the order has been accepted, processed or shipped.

  1. PRICES AND PAYMENT

Prices are shown in U.S. dollars unless otherwise stated. Prices, promotions and product availability may change without notice.

Applicable taxes, shipping charges, freight charges and other disclosed fees will be added at checkout or communicated for approval when a separate quote is required.

You agree to provide current, complete and accurate billing, shipping and contact information. You represent that you are authorized to use the payment method submitted with your order.

If a product is displayed with a material pricing or description error, we may contact you for approval of the corrected terms or cancel and refund the affected product.

  1. DROPSHIPPING AND THIRD-PARTY FULFILLMENT

Some products are stored, processed or shipped directly by manufacturers, distributors or third-party suppliers. Products may ship from locations outside California.

Orders containing multiple products may arrive in separate packages, from different locations or on different dates. Supplier inventory and lead times can change without notice.

Processing times, estimated delivery times, freight shipments, backorders and shipping delays are governed by our Shipping and Pickup Policy.

If we cannot ship within the time originally stated, we will provide notice and any cancellation or refund options required by applicable law.

  1. SPECIAL ORDERS AND FINAL-SALE PRODUCTS

Special-order, custom-made and personalized products are final sale. They cannot be canceled, returned or exchanged once the order has been placed with the manufacturer or supplier.

Customers are responsible for reviewing and approving all product details, measurements, colors, finishes, specifications and vehicle information before a special order is submitted.

A special-order product may still qualify for assistance if it arrives damaged, defective or materially different from the approved order, subject to inspection and applicable warranty rights.

Products clearly identified as “Final Sale” are not eligible for return or exchange except where required by law.

  1. SHIPPING, DELIVERY AND LOCAL PICKUP

Shipping and local pickup are governed by our Shipping and Pickup Policy.

Delivery estimates are not guaranteed. Risk of loss and legal title will transfer as provided by applicable law and the terms of the carrier or transaction.

Customers must provide accurate shipping and contact information. Additional costs caused by an incorrect address, refused delivery or failed delivery attempt may be charged to the customer unless the issue resulted from our error.

Local-pickup customers must wait for a ready-for-pickup notification before visiting our location.

  1. RETURNS AND REFUNDS

Returns, cancellations and refunds are governed by our Return and Refund Policy.

Eligible unopened and unused products may be returned within 30 days after delivery if they meet all return conditions. Prior return approval is required.

Original shipping charges and return shipping costs are generally nonrefundable unless the product was damaged, defective or supplied incorrectly.

  1. INSTALLATION AND PRODUCT USE

Certain automotive products require professional installation, specialized tools, calibration, programming or modifications to the vehicle.

Unless installation services are expressly included in the order, the purchase price covers the product only. Installation and removal costs are not included.

Customers are responsible for:

  • Following manufacturer instructions and warnings

  • Using qualified installers when appropriate

  • Confirming proper installation before operating the vehicle

  • Performing required maintenance

  • Using products only for their intended purposes

  • Complying with applicable vehicle, safety and emissions laws

Damage caused by improper installation, modification, misuse, neglect, racing, competition, abuse or use contrary to manufacturer instructions may not be covered by a return or warranty.

Do not operate a vehicle if installation may have affected its safe operation. Obtain professional inspection when necessary.

  1. EMISSIONS AND REGULATORY COMPLIANCE

Certain performance products may be restricted to racing, competition or off-road use and may not be legal for use on pollution-controlled vehicles or public roads.

Customers are responsible for reviewing product disclosures and confirming that installation and use are lawful in the jurisdiction where the vehicle will be registered or operated.

A product’s availability for purchase does not necessarily mean it is legal for every vehicle, location or intended use. We reserve the right to decline or cancel orders involving restricted products.

Nothing in these terms permits tampering with emissions-control equipment or any other unlawful vehicle modification.

  1. WARRANTIES

Products may be covered by warranties offered by their manufacturers. Warranty terms, exclusions and claim procedures vary by product.

Unless we expressly provide a separate written warranty, product warranties are provided by the applicable manufacturer. We may assist with a warranty claim, but the manufacturer generally determines eligibility and the available remedy.

Manufacturer warranties may exclude labor, diagnostic charges, removal, installation, shipping, vehicle downtime, rental costs, incidental expenses and damage caused by misuse or improper installation.

Nothing in these terms limits warranties or consumer rights that cannot legally be excluded.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to manufacturer websites, payment providers, financing providers, shipping carriers or other third parties.

We do not control and are not responsible for third-party websites, content, services, policies or availability. Your use of a third-party service may be governed by that party’s separate terms and privacy policy.

  1. PERSONAL INFORMATION

The submission and handling of personal information through the website are governed by our Privacy Policy.

You agree to provide accurate information needed to process orders, prevent fraud, provide customer service and fulfill our legal obligations.

  1. REVIEWS, PHOTOGRAPHS AND SUBMISSIONS

If you voluntarily submit a review, photograph, suggestion or other content, you represent that you have the right to provide it and that it does not violate another person’s rights or applicable law.

You grant us a nonexclusive, worldwide and royalty-free right to use, reproduce and display submitted content for operating and promoting our business, unless otherwise agreed in writing.

We may remove content that is unlawful, abusive, misleading, infringing or otherwise inappropriate.

  1. PROHIBITED USES

This may include lost profits, lost revenue, loss of use, vehicle downtime, towing, storage, rental costs or data loss, except where liability cannot legally be limited.

Our total liability for a claim relating to a product or transaction will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in these terms limits liability for fraud, willful misconduct, personal injury caused by negligence or any other liability that cannot legally be limited.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Empire Motorsports & LINE-X harmless from third-party claims arising from your unlawful use of the website, violation of these terms, infringement of another person’s rights, or unlawful or improper installation or use of a product.

  1. TERMINATION

We may suspend or terminate access to the website if you materially violate these terms or use the website unlawfully.

Obligations and liabilities incurred before termination will survive as necessary to give them effect.

  1. SEVERABILITY

If any provision of these terms is found unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

  1. NO WAIVER

Our failure to enforce a provision of these terms does not waive our right to enforce it later.

  1. ENTIRE AGREEMENT

These Terms of Service and the policies referenced within them constitute the agreement between you and Empire Motorsports & LINE-X regarding use of the website and purchases made through it.

Product-specific written terms or an approved special-order agreement may supplement these terms. If a product-specific term conflicts with these general terms, the more specific disclosed term will govern that product to the extent permitted by law.

  1. GOVERNING LAW

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute that is not resolved informally will be handled by a court with appropriate jurisdiction, subject to any rights or venue requirements that cannot legally be waived.

  1. CHANGES TO THESE TERMS

We may update these Terms of Service by posting a revised version on the website. The effective date shown at the top will indicate when the latest version became effective.

Changes apply prospectively and do not alter the terms of a completed purchase unless permitted by law.
